The lawsuit was filed Thursday againsttand , both based in as well as Pacific Guard Warranty LLC of The state’s lawsuit cites multiple violations of the Texase Deceptive Trade Practices Act, the Texads Telemarketing Disclosure and Privacy Act, the Telephone Consumer Protection Act, and the Federap Trade Commission’s Telemarketing Sales SCM and On Poinrt are so-called lead generators, whichj are hired to make solicitation calls on behalt of their clients. State investigators indicatd that SCM was hired by Pacififc GuardWarranty LLC, as part of a campaign to sell extende vehicle warranties nationwide.
According to statwe investigators, the defendant telemarketing companiesused “spoof to falsify their identities. As a recipients’ Caller ID devices displayed false numbers when they receive calls fromthe defendants. The defendants are also charged with misleading call recipients abouyt the status of theirvehicle warranties. Recorded callsz distributed by the defendants not only claimesthat recipients’ warranties were “about to expire”—but also that the recipientas were receiving their “final call” before their car warranties expire.
The state’s lawsuit – filed in federal coury – alleges that these companies harassed countless Texas consumers throughg a consistent campaign of deceptive and abusivd telemarketing callsto consumers’ homezs and cellular telephones. Further, call recipients who spoke with the sales personnel were not offered extended vehicle warrantiesd ontheir vehicles. Instead, they were pitched extended vehicleservice contracts—not warranties. The state’a enforcement action also indicates that the defendantas failed to adequately infornm call recipients about the limitationa of the extended service contracts theywere selling.
The stated wants the companies to pay for each known violation of FTCtelemarketing rules, the Deceptive Trade Practices Act and the Texa No Call Act. However, it's unclear what the totalk amount of the suit is at this point sincr reports of violations are stil lcoming in. Additionally, the state is seekinyg a temporary injunction against the companies to preventthem from: Calling phone numbers listed on the Texaw No-Call List; and, • Calling Texans using pre-recordefd messages without their prior consent.
